This site is owned and operated by Basin Radio Network and is part of the Legend Communications of Wyoming, LLC., family of companies, which includes Basin Radio Network in Gillette, Wyoming; Big Horn Mountain Radio Network in Buffalo, Wyoming; and Big Horn Radio Network in Cody, Wyoming. 

By using the Basin Radio Network website you agree to be bound by these Terms of Use (this “Agreement”), whether or not you register for an account on any part of our website.  “Our website” refers to the collection of websites listed under the basinsradio.com domain name including, but not limited to, basinsradio.com/basin; basinsradio.com/fox; basinsradio.com/drive; basinsradio.com/kaml; and basinsradio.com/kiml.

Basin Radio Network provides this Basin Radio Network Website and related services for your personal non-commercial use only and subject to your compliance with this Agreement. Please read this Agreement carefully before using this Basin Radio Network Website. Your use of this Basin Radio Network Website constitutes your acceptance to be bound by this Agreement without limitation, qualification or change. If at any time you do not accept all the terms and conditions of this Agreement, you must immediately discontinue use of this Basin Radio Network Website. This Agreement sets forth Basin Radio Network’s policies with respect to its operation of the Basin Radio Network Websites. Other policies govern Basin Radio Network’s non-Internet operations.

Certain products or services offered by this and/or other Basin Radio Network Websites (each a “Basin Radio Network Internet Service,” and collectively “Basin Radio Network Internet Services”), and certain areas within this and/or other Basin Radio Network Websites may be governed by additional terms (“Additional Terms”) presented in conjunction with those products or services. You must agree to these Additional Terms before using those areas or Basin Radio Network Internet Services. The Additional Terms and this Agreement shall apply equally. In the event of an irreconcilable inconsistency between the Additional Terms and this Agreement, the Additional Terms shall control.

YOU MAY NOT USE ANY BASIN RADIO NETWORK WEBSITE FOR ANY PURPOSE THAT IS UNLAWFUL OR PROHIBITED BY THIS AGREEMENT AND/OR ANY APPLICABLE ADDITIONAL TERMS. YOUR ACCESS TO ANY BASIN RADIO NETWORK WEBSITE MAY BE TERMINATED IMMEDIATELY AT BASIN RADIO NETWORK’S SOLE DISCRETION, WITH OR WITHOUT NOTICE, IF YOU FAIL TO COMPLY WITH ANY PROVISIONS OF THIS AGREEMENT AND/OR ADDITIONAL TERMS, OR FOR ANY OTHER REASON, OR FOR NO REASON AT ALL.

Terms
This Agreement shall remain in full force and effect while you use the Website. You may terminate your registration at any time, for any reason, by contacting Basin Radio Network by calling (307) 686-2242.  In addition, Basin Radio Network may terminate your registration for any reason and at any time.  Even after registration is terminated, this Agreement will remain in effect.

Non Commercial Use
The Website is for the personal use of Basin Radio Network users only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by the management of Basin Radio Network and explicitly provided on this website for such purposes. Illegal and/or unauthorized use of the Website, including collecting user names by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website is not permitted. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from personal profiles without notice. Appropriate legal action will be taken by Basin Radio Network for any illegal or unauthorized use of the Website.

Changes to this Agreement
Basin Radio Network reserves the right, in its sole discretion, to modify, alter, or otherwise change this Agreement and/or the Additional Terms at any time. Basin Radio Network will provide notice of such change on this Basin Radio Network Website. Please review this Agreement and/or Additional Terms periodically for changes. Your continued use of the Basin Radio Network Website and/or Basin Radio Network Internet Service constitutes your acceptance and agreement to be bound by these changes without limitation, qualification or change. If at any time you do not accept these changes, you must immediately discontinue use of this Basin Radio Network Website and/or the Basin Radio Network Internet Service to which the changes may apply.

Privacy and Protection of Personal Information

User Account Registration, Security, and Passwords
If a particular Basin Radio Network Website or Basin Radio Network Internet Service requires you to open an account, you must complete the specified registration process by providing us with current, complete, and accurate information as requested by the applicable online registration form. You further represent and warrant that you are 14 years of age or older and that your use of the Website will not violate any applicable law or regulation. Your personal profile may be deleted without warning if it is found that you are misrepresenting your age. Your registration is solely for your personal use, and you shall not authorize others to use your account, including your personal profile or email address. You are solely responsible for all content published or displayed through your account and for your interactions with other registered users.  It is your responsibility to maintain the currency, completeness, and accuracy of your registration data and any loss caused by your failure to do so is your responsibility. After you have fully completed the registration form, you may be asked to choose a password and a user name. It is entirely your responsibility to maintain the confidentiality of your password and account. Additionally, you are entirely responsible for any and all activities that occur under your account. You agree to notify Basin Radio Network immediately of any unauthorized use of your account. Basin Radio Network is not liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You may cancel your account by delivering notice in the manner provided in the Additional Terms governing the particular Basin Radio Network Internet Service.

Posting comments on any of Basin Radio Network’s websites under a registered username requires separate user accounts with either Facebook, Twitter, OpenID, IntenseDebate, or WordPress.com.  Before setting up a user account with any of these providers, completely read and agree to their separate privacy policies and terms and conditions.

Fees
Except where otherwise provided, access to this Basin Radio Network Website site is currently available without charge. Basin Radio Network reserves the right to charge a fee for access to or use of this Basin Radio Network Website, or any Basin Radio Network Internet Service available on this Basin Radio Network Website at any time in the future. Your access to this Basin Radio Network Website before such time does not entitle you to use of this Basin Radio Network Website without charge in the future.

Disclaimer of Warranties

Basin Radio Network is not responsible for any failures caused by server errors, misdirected or redirected transmissions, failed Internet connections, interruptions in the transmission or receipt of ticket orders, or Basin Radio Network Interactive Services, or any computer virus or other technical defect, whether human or technical in nature.

The opinions expressed in Content posted on the Website are not necessarily the opinions of Basin Radio Network. Basin Radio Network is not responsible for any incorrect or inaccurate Content posted on the Website, whether caused by users of the Website or by any of the equipment or programming associated with or utilized by the Website. Basin Radio Network is not responsible for the conduct, whether online or offline, of any user of the Website. Basin Radio Network assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user communication. Your use of the Software is limited to private, non-commercial use and is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software. Basin Radio Network accepts no responsibility or liability in connection with any Software owned or controlled by third parties.

Modification/Termination
Basin Radio Network reserves the right, in its sole discretion, to modify, suspend, or terminate this Basin Radio Network Website and/or any portion thereof, including any Basin Radio Network Internet Service, and/or your account, password, or use of any Basin Radio Network Internet Service, or any portion thereof, at any time for any reason with or without notice to you.

Termination of your account for a Basin Radio Network Internet Service removes your authorization to use the Basin Radio Network Internet Service. In the event of termination, you will still be bound by your obligations under this Agreement and any Additional Terms, including the warranties made by you, and by the disclaimers and limitations of liability. Additionally, Basin Radio Network shall not be liable to you or any third-party for any termination of your access to a Basin Radio Network Internet Service.

Content Posted on the Site
(a) You understand and agree that Basin Radio Network, in its sole discretion, may review and delete any reader comments, personal profiles, information and photographs contained in personal profiles, and messages to other registered users (collectively, “Content”). (b) You are solely responsible for the Content that you publish or display (hereinafter, “post”) on the Website or any material or information that you transmit to other registered users. (c) By posting any Content to the public areas of the Website, you hereby grant to this Basin Radio Network Website the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. Content posted to the public areas of the Website may be used on the air on the radio station, the radio station’s affiliate stations or the streaming station for commercial or entertainment use. This includes but is not limited to comments, video, audio, photos and all other content posted to public areas of the Website. If you would like to request that any of your Content be removed from the Website, please contact us by calling (307) 686-2242 during normal business hours. We will consider your request, but have the right to deny any request if we determine in our sole discretion that removal of the Content in question would harm the experience of our users on the Website. You represent and warrant that: (i) you own the Content posted by you on the Website or otherwise have the right to grant the license set forth in this section, and (ii) your Content does not violate the privacy rights, publicity rights, copyright rights, or other intellectual property rights of any person. You agree to pay for all royalties and fees owing any person by reason of any Content you post on the Website. (d) The following is a partial list of the kind of Content that is illegal or prohibited on the Website. This Basin Radio Network Website reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Website and terminating the registration of such violators. Prohibited Content includes Content that: (i) is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (ii) harasses or advocates harassment of another person; (iii) involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing or “spamming;” (iv) promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; (v) promotes an illegal copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; (vi) contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page); (vii) provides material that exploits anyone in a sexual or violent manner, or solicits personal information from anyone; (viii) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; (ix) solicits passwords or personal identifying information for commercial or unlawful purposes from other users; (x) involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; or (xi) uses sexually suggestive imagery or any other unfair, misleading or deceptive content intended to draw traffic to a personal profile. (e) You must use the Website in a manner consistent with any and all applicable laws and regulations. (f) You may not engage in advertising to, or solicitation of, any user of the Website to buy or sell any products or services except where explicitly permitted. (j) You may not use the account, user name, or password of another registered user at any time nor may you disclose your password to any third party or permit any third party to access your account. (k) You may not sell or otherwise transfer your personal profile.

Interactive Services
This Basin Radio Network Website may offer certain Basin Radio Network Internet Services having interactive components such as bulletin boards, chat rooms, blogs, and forums (collectively "Basin Radio Network Interactive Services")

You may participate in the Basin Radio Network Interactive Service by reading and agreeing to the Terms of Use Agreement and these Interactive Service Additional Terms, and by completing the registration form where one is provided. If you do not agree to abide by the Terms of Use Agreement and these Interactive Service Additional Terms, you may not participate in the Basin Radio Network Interactive Service.

You agree that you will not:

• Deliver any unsolicited advertisement, promotional materials, junk email, bulk email (also known as “spam”), chain letters, surveys or contests, or solicit participation in any pyramid schemes (unless it is on a page that explicitly states that such postings are allowed on that page).
• Deliver any unlawful (according to local, state, federal, or international law or regulation) postings to or through the Basin Radio Network Website, or any postings which advocate illegal activity.
• Deliver, or provide links to, any postings containing material that could be considered harmful, obscene, pornographic, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, hateful or otherwise objectionable.

Subscription Services
This Basin Radio Network Website may offer certain Basin Radio Network Subscription Services such as newsletters and Real Simple Syndication ("RSS") feeds (collectively "Basin Radio Network Subscription Services"). By registering for a Basin Radio Network Subscription Service, you will be subject to any charges and rules set forth in the description of that service.

User Disputes
You are solely responsible for your interactions with other registered users. This Basin Radio Network Website reserves the right, but has no obligation, to monitor disputes between you and other users.

Limitations on Liability

Indemnification
You agree to indemnify, defend, and hold harmless Basin Radio Network, its subsidiaries, agents, distributors and affiliates, and their officers, directors and employees from and against any and all claims, actions, demands, liabilities, costs and expenses, including, without limitation, reasonable attorneys’ fees, resulting from your breach of any provision of this Agreement, the Additional Terms, or any warranty you provide herein, or otherwise arising in any way out of your use of this Basin Radio Network Website and any related Basin Radio Network Internet Service and/or software. Basin Radio Network reserves the right to take exclusive control and defense of any such claim otherwise subject to indemnification by you, in which event you will cooperate fully with Basin Radio Network in asserting any available defenses.

International Use/U.S. Export Controls
Accessing materials on this Basin Radio Network Website by certain persons in certain countries may not be lawful, and Basin Radio Network makes no representation that materials on this Basin Radio Network Website are appropriate or available for use in locations outside the United States.
