The Bureau of Land Management High Plains District Office is issuing a correction to the Record of Decision (ROD) for the final environmental impact statement (FEIS) for the South Gillette Area Maysdorf II coal lease by application ROD.
The purpose of this action corrects the inadvertently omitted wording and associated stipulations on page 19 in the section titled “Conformance With Existing Land Use Plans” and in Appendix 2 of the Maysdorf II ROD published in the Federal Register on Friday, Aug. 30, 2012 (77 FR 52756). The corrected wording applies to Maysdorf II coal lease by application tract WYW173360 and tract WYW180711; and refers to the railroad right-of-way, Hilight Road right-of-way, and Highway 59 right-of-way.
On Sept. 1, 2006, Cordero Mining Company (Cordero) applied for a maintenance coal lease for approximately 4,653.8 acres (approximately 504 million tons of in-place coal as estimated by Cordero) in a maintenance tract of federal coal adjacent to the Cordero-Rojo Mine in Campbell County, Wyo. The BLM determined that the application would be processed as two separate tracts. The tracts are referred to as the Maysdorf II North Tract and Maysdorf II South Tract. A record of decision was issued for each tract that was analyzed in the EIS and is available at: http://www.blm.gov/wy/st/en/info/NEPA/documents/hpd/SouthGillette.html. Two separate competitive sealed bid lease sales will be held and announced in the Federal Register at a later date.
This corrected ROD (1) changes language on page 19 under the section titled “Conformance With Existing Land Use Plans”; (2) adds language to the same section on page 19 to address the unavailability for mining the railroad right-of-way consistent with Unsuitability Criteria 2, and two public road rights-of-way consistent with unsuitability Criteria 3 of the Approved Resource Management Plan for Public Lands Administered by the Bureau of Land Management, Buffalo Field Office (2001); and (3) adds two special stipulations to the standard coal lease form (see ROD, Appendix 2) as was stated would occur in the South Gillette Area Coal Lease Applications Environmental Impact Statement (SGA EIS). The additional and corrected language does not change the High Plains District Manager’s decision to choose Alternative 3. The additional and corrected language is consistent with the application of unsuitability criteria required by the Surface Mining Control and Reclamation Act of 1977, BLM regulations at 43 CFR 3461, and analyses provided in the SGA EIS.
This corrected ROD is subject to appeal to the Interior Board of Land Appeals (IBLA) as provided in 43 CFR 4 within 30 days from the date of publication of the notice of availability in the Federal Register. The corrected ROD contains instructions for filing an appeal with the IBLA.
